Terms of Service
Effective date: September 22, 2026
These Terms of Service (“Terms”) govern your purchase of, access to and use of Content on Cue, including contentoncue.com, Content on Cue memberships, free trials, text-message programs, story libraries, file-upload features and related services.
Content on Cue is operated by Brandi Herrman Communications LLC, doing business as Content on Cue (“Content on Cue,” “BHC,” “we,” “our,” or “us”).
By purchasing a membership, registering for a trial, submitting information, consenting to receive prompts or otherwise using Content on Cue, you agree to these Terms and our Privacy Policy.
If you are using Content on Cue on behalf of an organization, you represent that you have authority to accept these Terms on behalf of that organization. In that case, “you” and “your” refer to both you and the organization.
If you do not agree to these Terms, do not purchase or use Content on Cue.
1. About Content on Cue
Content on Cue is a story- and information-capture service. It uses customized SMS and MMS prompts to help individuals and organizations capture stories, insights, examples, photographs, audio, video and other source material.
Depending on the membership or written agreement, the service may include:
An initial strategy conversation
Customized prompts delivered by text
The ability to respond by text, photograph, voice memo, audio or video
Organization of responses into a story library
Monthly summaries or digests
Inactivity reminders or encouragement
Periodic adjustment of prompt topics
Strategy check-ins
Export of submitted content
Unless a separate written agreement expressly states otherwise, Content on Cue does not include:
Social-media management
Writing or editing finished posts
Graphic design
Website management
Publishing content
Managing advertising
Public relations services
Monitoring customer social-media accounts
Guaranteed marketing, fundraising or sales results
Additional communications services may be available through a separate agreement with Brandi Herrman Communications LLC.
2. Eligibility
You must be at least 18 years old and legally capable of entering a contract to purchase or use Content on Cue.
Content on Cue is designed for businesses, nonprofit organizations and adult users. It is not directed to children under 13.
If you submit content involving a minor, you are responsible for obtaining permission from the minor’s parent, guardian or other authorized person.
3. Standard Membership
Unless otherwise stated at checkout or in a separate written agreement, a standard Content on Cue membership includes:
One participating contributor
One initial 30-minute strategy conversation
Approximately three customized prompts per week
Responses by text, photograph, voice memo, audio or video
An organized story library
A monthly digest of captured material
Reasonable inactivity reminders
Adjustments to prompts as organizational priorities evolve
A strategy check-in after approximately six months of continuous membership
The ability to request an export of submitted content
Membership features may be modified by mutual written agreement.
Additional contributors, prompt streams, storage, strategy services or organizational features may require a Team or Partner arrangement and an additional fee.
4. Prompt Frequency and Scheduling
A standard membership typically includes three customized prompts per week.
Prompt timing and frequency may occasionally vary because of:
Holidays
Customer preferences
Strategic adjustments
Technical problems
Carrier delays
Service-provider interruptions
Temporary pauses requested by the customer
Other reasonable operational circumstances
Content on Cue does not guarantee that a prompt will arrive on a particular day or at a particular time unless that commitment is included in a separate written agreement.
Delayed or missed prompts do not automatically entitle a customer to a refund. If a substantial service interruption occurs, contact us so we can review the account and determine an appropriate response.
5. Recurring Billing
Content on Cue memberships are billed monthly in advance and automatically renew each month until canceled.
By purchasing a membership, you authorize Content on Cue and its payment processor to charge the payment method associated with your account for:
The recurring membership fee shown at checkout
Any applicable taxes
Any separately approved additional services or storage
You are responsible for keeping your billing and contact information current.
The price and billing frequency displayed at checkout apply to the membership. We will provide reasonable advance notice of any change to the recurring membership price.
A price change will not take effect before the customer’s next renewal date following the notice.
6. Founding-Member Rate
Customers who join through the Content on Cue founding cohort receive the founding-member rate displayed at checkout for as long as the original membership remains continuously active.
A temporary failed payment will not immediately cause a customer to lose the founding-member rate. If the outstanding payment is corrected within the 20-day grace period described below, the membership will be treated as continuously active.
If a founding membership is voluntarily canceled or is terminated after the payment grace period, the founding-member rate is forfeited.
If the customer later rejoins, the new membership will be subject to the price and terms then in effect.
Founding-member pricing is not transferable to another person or organization without our written agreement.
7. Failed Payments and Grace Period
If a recurring payment fails, Content on Cue may notify you and request an updated or alternative payment method.
You will have 20 calendar days from the date of the failed payment to correct the payment issue and pay the outstanding balance.
Content on Cue may limit or pause portions of the service during the grace period if continued messaging, storage or support would result in additional costs. We will make reasonable efforts to notify you before suspending service.
If the outstanding balance is paid during the 20-day grace period, the membership may resume without requiring a new enrollment, and an eligible founding-member rate will remain in effect.
If payment is not received within 20 calendar days, Content on Cue may:
Suspend or terminate the membership
Stop sending prompts
Stop accepting new submissions
Restrict access to membership features
Begin the post-cancellation export and retention period
Seek payment of amounts properly owed
Termination for nonpayment does not eliminate responsibility for charges incurred before termination.
8. Cancellation
You may cancel your membership by emailing info@contentoncue.com with the subject line:
Cancel My Content on Cue Membership
Your request must include the name and email address associated with the membership so we can identify the correct account.
Cancellation becomes effective at the end of the current paid billing period. To avoid the next recurring charge, your cancellation email must be received before the next scheduled renewal date.
Content on Cue will send an email acknowledging the cancellation request. If you do not receive an acknowledgment within two business days, please follow up at info@contentoncue.com.
Canceling a membership:
Stops future renewal charges
Does not retroactively refund charges already processed
Does not immediately erase submitted content
Begins the 30-day post-cancellation export period
Causes the founding-member rate to be forfeited
Payments are nonrefundable except where required by law or expressly agreed to by Content on Cue in writing.
9. SMS and MMS Communications
Content on Cue uses recurring SMS and MMS messages to deliver prompts and operate the service.
You must separately consent to receive these messages at the mobile number provided. Messages may include:
Customized prompts
Follow-up questions
Reminders
Inactivity check-ins
Account notifications
Customer-support messages
Other service-related communications
Message frequency varies but typically includes three prompts per week, along with occasional service-related messages.
Message and data rates may apply.
Reply STOP to opt out of SMS or MMS messages. After opting out, you may receive one final message confirming the request.
Reply HELP for assistance or email info@contentoncue.com.
Wireless carriers are not responsible for delayed or undelivered messages.
Because text messaging is the primary delivery method for Content on Cue, opting out may prevent us from providing the central features of the membership. An SMS opt-out does not automatically cancel billing for an active membership. To cancel the paid membership, follow the cancellation process in Section 8.
Consent to receive Content on Cue messages is not consent to receive unrelated third-party marketing.
10. Organization-Provided Contributors
An organization may ask an employee, member, volunteer, client or other individual to participate as a contributor.
The organization is responsible for:
Obtaining the contributor’s permission before providing the person’s contact information
Explaining how the organization intends to use the contributor’s responses
Determining whether the organization has the right to access and use those responses
Ensuring that its participation instructions comply with employment, privacy and other applicable laws
Avoiding coercive or inappropriate participation requirements
Obtaining any necessary permission involving names, images, voices or personal information
Each contributor must also complete any consent required to receive recurring SMS or MMS messages.
Content on Cue is not responsible for disputes between an organization and its contributors concerning employment, ownership, confidentiality or the organization’s later use of submitted material.
11. Ownership of Customer Content
“Customer Content” means text, messages, stories, photographs, audio, voice memos, videos, documents and other material submitted through Content on Cue by or for a customer or contributor.
As between you and Content on Cue, you retain ownership of your Customer Content.
You grant Content on Cue a limited, nonexclusive, worldwide license to receive, copy, process, organize, store, transmit and return Customer Content solely as reasonably necessary to:
Provide the service
Maintain the customer’s story library
Prepare digests or exports
Develop or adjust customized prompts
Provide customer support
Protect and maintain the service
Comply with applicable law
This limited license does not transfer ownership of Customer Content to Content on Cue.
Content on Cue will not sell Customer Content or use it in public advertising, testimonials or case studies without separate permission.
The license granted in this section ends when the Customer Content is deleted from our active systems, except to the extent temporary copies remain in routine backups or retention is required by law.
12. Your Responsibility for Customer Content
You represent that:
You own the Customer Content or have permission to submit it
You have obtained any necessary permission to submit another person’s name, likeness, voice or personal information
The Customer Content does not unlawfully infringe another person’s intellectual-property, privacy, publicity or contractual rights
The Customer Content is not illegal, fraudulent, defamatory, threatening or malicious
Submitting the Customer Content does not violate an employment obligation, confidentiality agreement or other duty
Content on Cue does not independently verify that you have permission to submit or use Customer Content.
You are responsible for reviewing Customer Content before publicly publishing or otherwise using it.
13. Confidentiality and Human Access
Content on Cue will not knowingly make private Customer Content publicly available without permission.
Authorized Content on Cue or BHC team members may review Customer Content when reasonably necessary to:
Customize or adjust prompts
Organize a story library
Prepare a monthly digest
Prepare an export
Respond to a support request
Troubleshoot a technical issue
Protect the service from misuse
Comply with legal obligations
Access will be limited to people who reasonably need the information to perform their responsibilities.
Content on Cue cannot guarantee that every submission will be confidential. Customers should not submit trade secrets, privileged communications or other exceptionally sensitive information unless separate written safeguards have been established.
14. Storage and Reasonable-Use Limits
A Content on Cue membership includes a reasonable amount of storage for text responses, photographs, audio, video and supported files submitted through ordinary use of the service.
Content on Cue may establish or update reasonable technical limits concerning:
Individual file size
Video or audio length
Total storage
Supported file formats
Upload frequency
Retention of unusually large files
Excessive or abusive use
Current limits may be displayed on the website, in membership materials or through account communications.
If your usage approaches or exceeds the storage included with your membership, we may provide notice and offer options such as:
Exporting and removing older material
Reducing or compressing stored files
Purchasing additional storage
Moving files to another customer-approved storage location
Entering a separate storage agreement
Content on Cue will not impose an additional storage charge without first disclosing the amount and obtaining your agreement.
If you decline additional storage, we may stop accepting new files that exceed the included limits.
We will not intentionally delete active Customer Content solely because a storage limit has been exceeded without providing reasonable notice and an opportunity to export or reduce the stored material, except when immediate action is reasonably necessary to address illegal material, malicious files, security threats or service abuse.
15. Content Exports
You may request an export of Customer Content:
At any time during an active membership; or
Within 30 calendar days after the membership ends
Export requests must be sent to info@contentoncue.com with the subject line:
Content Export Request
The request must include the name and email address associated with the membership.
We may ask for additional information reasonably necessary to verify the requester’s identity or authority to receive the material.
Exports may be prepared manually. Content on Cue will make reasonable efforts to provide an export within 10 business days after verifying the request.
Exports may be delivered through:
A secure download link
A shared folder
Multiple electronic files
A spreadsheet or document
Another reasonable electronic method
The format will depend on the systems used to store the material. We do not guarantee that exports will include every item of technical metadata, original message formatting, carrier information or third-party platform data.
Customers are responsible for downloading and preserving exported material after delivery.
After the 30-day request period expires, Content on Cue may delete or de-identify remaining Customer Content, subject to legal, tax, accounting, fraud-prevention, security and routine backup-retention requirements.
16. Privacy and Service Providers
Our collection and use of personal information are described in the Content on Cue Privacy Policy, which is incorporated into these Terms.
Content on Cue may use third-party providers to operate the service, including providers for:
Website hosting and commerce
Payment processing
SMS and MMS delivery
Workflow automation
File storage
Email
Scheduling
Analytics
Customer support
These providers may process information as reasonably necessary to perform their services.
Content on Cue does not sell or rent personal information, mobile opt-in information or Customer Content.
17. Prohibited and Regulated Information

20. Feedback and Testimonials
If you voluntarily provide suggestions about improving Content on Cue, we may use those suggestions to evaluate or improve the service without payment or attribution.
This permission applies only to product or service feedback. It does not give Content on Cue ownership of Customer Content, private stories, submitted media or confidential organizational information.
We will not publicly identify you, quote you in a testimonial or publish your Customer Content as a case study without separate permission.

You may terminate your membership through the cancellation process described in Section 8.
Content on Cue may suspend or terminate access if:
Payment remains outstanding after the 20-day grace period
You materially violate these Terms
Your use creates a security or legal risk
You submit prohibited or malicious material
You misuse the messaging system
Continued service would violate applicable law
You engage in abusive conduct toward Content on Cue personnel

When practical, we will provide notice and a reasonable opportunity to correct a violation before termination.
Immediate suspension or termination may occur when reasonably necessary to protect people, data, systems or legal rights.
Sections concerning payment obligations, ownership, permissions, disclaimers, liability, disputes and other provisions that logically should survive termination will remain in effect.
24. Disclaimer of Warranties
To the fullest extent permitted by law, Content on Cue is provided on an “as is” and “as available” basis.
We make no warranty that:
The service will be uninterrupted or error-free
Every message or file will be delivered or preserved
Every submitted response will be suitable for publication
The service will meet every customer requirement
Third-party services will remain continuously available
Use of the service will produce a particular business or marketing result
Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.
25. Limitation of Liability
To the fullest extent permitted by law, Content on Cue and Brandi Herrman Communications LLC will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, including lost profits, lost revenue, lost opportunities, loss of goodwill or loss of data, arising from or related to the service.
To the fullest extent permitted by law, the total liability of Content on Cue and Brandi Herrman Communications LLC for claims arising from or related to the service will not exceed the amount you paid for Content on Cue during the six months immediately preceding the event giving rise to the claim.

27. Governing Law and Venue
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, any legal action arising from these Terms or Content on Cue will be brought in the state or federal courts with jurisdiction over Boone County, Missouri.

28. Changes to the Service or Terms
We may update the service or these Terms to reflect changes in:
Membership features
Technology

If a change materially affects an active membership, recurring price, ownership of Customer Content or the customer’s legal rights, we will provide reasonable advance notice when required or reasonably appropriate.
Continued use of the service after revised Terms take effect constitutes acceptance of the revised Terms. If you do not agree to a material change, you may cancel the membership before the change takes effect.
